2. Shipping Services and Third-Party Carriers

2.1. Send Stuff arranges transportation through independent third-party freight carriers and service providers.

2.2. Shipments are subject to applicable carrier conditions of carriage, international transport conventions, customs regulations and destination-country requirements.

2.3. We may engage subcontractors to perform collection, transport, delivery and related services.

2.4. Acceptance of a booking is subject to the goods being suitable for transportation and accepted by the relevant carrier.

2.5. We will exercise reasonable care and skill in providing our services.

3. Quotations and Bookings

3.1. All quotations are based on the shipment information provided by the customer, including contents, weight, dimensions, origin and destination.

3.2. Quotations may change if the information supplied is inaccurate or additional services are required.

3.3. A quotation is not a confirmed booking until Send Stuff has accepted the shipment and confirmed the arrangements.

3.4. Unless otherwise stated, payment is required before shipment dispatch.

3.5. Any additional charges arising from incorrect shipment information or services requested by the customer may be invoiced separately.

4. Customer Responsibilities

4.1. Customers must provide accurate and complete information about all goods being shipped.

4.2. Customers must disclose any potentially restricted or dangerous goods, including lithium batteries, aerosols, flammable liquids, chemicals and battery-powered equipment.

4.3. Customers must provide accurate customs values, item descriptions, recipient details and other documentation reasonably required.

4.4. Customers must ensure they own the goods or have authority to arrange their shipment.

4.5. Customers are responsible for reasonable additional costs directly arising from inaccurate information, prohibited goods or failure to meet applicable customs requirements, to the extent permitted by law.

5. Prohibited and Restricted Goods

5.1. Certain goods cannot be transported or require specialist approval, packaging or documentation.

5.2. Customers must not include prohibited, restricted or dangerous goods without prior written approval.

5.3. Send Stuff may refuse goods that do not comply with applicable laws or carrier requirements.

5.4. Undeclared dangerous goods may be subject to inspection, refusal, return, seizure or lawful disposal.

5.5. Specialist dangerous goods shipping enquiries may be assessed through Dangerous Goods Solutions Ltd. Acceptance is subject to the applicable regulations and carrier approval.

6. Packaging

6.1. Customers who pack their own goods are responsible for ensuring that the packaging is suitable for the contents and normal transportation conditions.

6.2. Fragile goods must be adequately protected using appropriate cushioning and packaging materials.

6.3. Send Stuff may recommend or require additional packaging before dispatch.

6.4. Where Send Stuff provides packaging services, those services will be identified in the quotation.

6.5. Responsibility for damage arising from packaging will be assessed according to the circumstances, the agreed services and applicable law.

7. Weight, Dimensions and Additional Charges

7.1. Freight charges may be calculated using actual or volumetric weight, whichever is greater.

7.2. Carriers may verify shipment weight and dimensions.

7.3. Additional charges may apply for incorrect dimensions, excess weight, remote areas, address corrections, failed deliveries, storage, inspections or other necessary services.

7.4. Customers are responsible for additional charges reasonably attributable to their shipment, subject to applicable law.

8. Customs, Duties and Taxes

8.1. International shipments may be subject to import duties, GST, VAT, customs clearance fees and other government charges.

8.2. Unless expressly included in the quotation, these charges are not included in the shipping price.

8.3. The customer is responsible for applicable destination-country duties, taxes and clearance charges unless otherwise agreed in writing.

8.4. If a carrier, customs broker or government authority charges Send Stuff directly for duties, taxes or other costs attributable to the customer's shipment, Send Stuff may pay those charges and invoice the customer for reimbursement.

8.5. The customer remains responsible for such charges even where the recipient was originally expected to pay them, to the extent permitted by law.

8.6. Goods described as used personal effects are not automatically exempt from customs duties or taxes.

8.7. Customs clearance, inspections and import decisions are controlled by the relevant authorities.

9. Collection and Delivery

9.1. Collection and delivery arrangements are subject to service availability.

9.2. Customers must ensure goods are ready for collection at the agreed location and time.

9.3. Delivery estimates are not guaranteed unless an expressly guaranteed service has been agreed.

9.4. Incorrect addresses, recipient unavailability or failed delivery attempts may result in additional charges.

9.5. Send Stuff will provide tracking information where available.

10. Delays

10.1. International shipping may be affected by customs inspections, airline disruptions, weather, security screening, public holidays and other circumstances outside our reasonable control.

10.2. Transit times are estimates unless expressly confirmed as guaranteed.

10.3. We will provide reasonable assistance with carrier enquiries and investigations.

10.4. Refunds or compensation for delays will depend on the agreed service, applicable carrier conditions and any statutory rights.

11. Insurance and Customer Risk

11.1. Send Stuff does not provide, arrange or include transit insurance for shipments.

11.2. Customers acknowledge that international transportation involves risks, including loss, theft, damage and delay.

11.3. Customers who require insurance protection are responsible for arranging suitable cover independently with an insurance provider of their choice before shipment.

11.4. Customers should ensure any independently arranged insurance covers the goods, destination, transportation method and full shipment journey.

11.5. The value declared for customs purposes does not constitute insurance and does not automatically increase the carrier's liability.

11.6. Any loss or damage not recoverable under applicable carrier liability provisions or other legal rights remains at the customer's risk.

11.7. Nothing in this section excludes or restricts liability that cannot lawfully be excluded.

12. Loss, Damage and Carrier Liability

12.1. Shipments may be subject to the Montreal Convention, Warsaw Convention or other applicable international carriage laws.

12.2. These laws and the applicable carrier conditions may limit compensation for loss, damage or delay.

12.3. Compensation is not automatically based on the declared customs value, purchase price or replacement value of the goods.

12.4. Where applicable, the Montreal Convention may establish a liability limit calculated using Special Drawing Rights (SDRs) per kilogram. The applicable limit will depend on the governing convention and the date and circumstances of carriage.

12.5. Where no international convention applies, the relevant carrier's contractual liability provisions may apply, subject to applicable law.

12.6. Send Stuff will assist customers with reasonable carrier claims and investigations relating to shipments arranged through us.

12.7. Any compensation payable will be determined by the applicable law, contractual obligations, circumstances of the loss and supporting evidence.

12.8. Send Stuff does not guarantee reimbursement of the full value of lost or damaged goods.

12.9. Nothing in these Terms excludes or restricts applicable rights under the Consumer Guarantees Act 1993 or other mandatory laws.

13. Claims for Lost or Damaged Goods

13.1. Customers must notify Send Stuff as soon as reasonably possible after discovering loss, damage or a delivery discrepancy.

13.2. To help preserve carrier claim rights, customers should report visible or concealed damage, shortages or delay promptly, preferably within seven calendar days of delivery.

13.3. Certain carriers and international conventions impose strict notification and claims deadlines. Customers should not delay reporting an issue.

13.4. Customers may be required to provide photographs, proof of value, shipment details, a packing list and other reasonable supporting information.

13.5. Original packaging and damaged goods should be retained where reasonably practicable until the investigation is completed.

13.6. We will assist with submitting and progressing a carrier claim where appropriate.

13.7. Claims remain subject to applicable law, mandatory time limits and relevant carrier conditions.

13.8. Nothing in this section reduces statutory rights that cannot lawfully be excluded.

14. Cancellations and Refunds

14.1. Customers may request cancellation by contacting Send Stuff in writing.

14.2. Send Stuff does not charge a separate cancellation penalty.

14.3. If a shipment is cancelled, the customer will only be charged for services already completed and reasonable costs already incurred in connection with the booking up to the time cancellation takes effect.

14.4. These may include packaging, documentation, collection, freight bookings or other services already performed or non-recoverable third-party charges.

14.5. Any remaining prepaid balance will be refunded to the customer.

14.6. Once a shipment has entered the transport network, cancellation, interception or return may not be possible.

14.7. Any applicable statutory cancellation or refund rights remain unaffected.

15. Undeliverable and Returned Shipments

15.1. Shipments may be returned or become undeliverable due to incorrect addresses, unpaid customs charges, prohibited goods, missing documentation or recipient refusal.

15.2. We will attempt to notify the customer and discuss available options where reasonably practicable.

15.3. Reasonable return freight, storage, redelivery or lawful disposal costs may be payable by the customer where the circumstances are attributable to them.

15.4. Goods will only be disposed of in accordance with applicable law and relevant carrier requirements.

16. Payments

16.1. Payment is required according to the terms stated in the quotation or invoice.

16.2. Send Stuff may require full payment before releasing goods for dispatch.

16.3. Additional charges properly payable under these Terms may be invoiced after dispatch or delivery.

16.4. Customers must pay valid invoices by the stated due date.

17. Privacy

17.1. Send Stuff collects personal information necessary to provide quotations, arrange shipments, communicate with customers and comply with legal obligations.

17.2. Relevant information may be shared with carriers, customs brokers, service providers and government authorities, including recipients outside New Zealand.

17.3. Personal information will be handled in accordance with the Privacy Act 2020 and our separate Privacy Policy.

18. Complaints and Disputes

18.1. Customers should contact Send Stuff promptly if they have a complaint about our services.

18.2. We will investigate complaints and seek a reasonable resolution.

18.3. Nothing in these Terms prevents customers from exercising statutory rights or referring eligible disputes to the appropriate New Zealand court or tribunal.

19. Governing Law

19.2. Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded.
